Welcome to 209.works. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.
1. Acceptance of Terms
By creating an account, posting jobs, or applying to jobs on 209.works, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our platform.
2. Eligibility
- You must be at least 16 years old to use this platform
 - You must provide accurate and complete information
 - Employers must be authorized to post jobs on behalf of their company
 - You may not use the platform for illegal or unauthorized purposes
 
3. User Accounts
Account Creation
- You are responsible for maintaining the confidentiality of your account
 - You must provide accurate, current, and complete information
 - One account per company for employers
 - You must notify us immediately of any unauthorized use
 
Account Termination
We reserve the right to suspend or terminate accounts that violate these terms, including but not limited to:
- Posting fraudulent or misleading job listings
 - Harassment or discrimination
 - Spamming or automated posting
 - Violation of applicable laws
 
4. For Employers
Job Posting Rules
- All jobs must be real, available positions
 - Jobs must be located within the 209 area code region
 - No multi-level marketing (MLM) or commission-only positions
 - No adult content or illegal activities
 - Job descriptions must be accurate and complete
 - Salary ranges must be truthful
 
Pricing and Payment
- Job posting fee: $99 per posting (subject to change)
 - Talent access upgrade: $199 (access to pre-qualified candidate matches)
 - Payment processed securely through Stripe
 - Job postings are active for 30 days from payment
 - No refunds after job is published
 - Jobs may be removed if they violate these terms
 
Refund Policy
- Refunds available within 24 hours if job not yet published
 - No refunds after job is live
 - No refunds for jobs removed due to terms violations
 - Contact us at jobs@209.works for refund requests
 
Application Management
- You are responsible for reviewing applications promptly
 - You must comply with all employment laws
 - You may not discriminate based on protected characteristics
 - Applicant data must be handled in accordance with privacy laws
 
5. For Job Seekers
Talent Marketplace
By applying to jobs or joining our talent pool, you agree that:
- We may create a searchable candidate profile from your application materials and resume
 - We may use AI to extract skills, certifications, experience, and qualifications from your resume
 - Your profile may be visible to multiple verified employers on our platform (not just the jobs you applied to)
 - We may proactively match you with relevant job opportunities based on your profile
 - Employers who purchase talent access can search and view candidate profiles
 - You can request removal from our talent pool at any time by contacting us
 
Application Guidelines
- Provide truthful and accurate information
 - Submit appropriate resumes and cover letters
 - Do not spam employers with multiple applications
 - Respect employer confidentiality
 
Your Responsibilities
- Verify job legitimacy before providing personal information
 - Report suspicious or fraudulent job postings
 - Follow up professionally with employers
 - Update your application materials as needed
 
6. Prohibited Conduct
Users may not:
- Use automated tools to scrape or collect data
 - Attempt to gain unauthorized access to the platform
 - Post malicious code or viruses
 - Impersonate another person or company
 - Harass, threaten, or abuse other users
 - Violate any applicable local, state, or federal laws
 - Sell or transfer your account to others
 - Post duplicate job listings
 
7. Intellectual Property
Our Content
All content on 209.works, including text, graphics, logos, and software, is owned by 209.works or its licensors and protected by copyright and trademark laws.
Your Content
By posting content (job listings, applications, profiles), you grant us a non-exclusive, worldwide license to use, display, and distribute your content on our platform. You retain ownership of your content.
8. Disclaimer of Warranties
209.works is provided "as is" without warranties of any kind. We do not guarantee:
- That job postings are accurate or legitimate
 - That you will find employment through our platform
 - That employers will hire from applications received
 - Uninterrupted or error-free service
 - That the platform is free from viruses or harmful components
 
9. Limitation of Liability
209.works shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the platform. Our total liability shall not exceed the amount you paid us in the past 12 months (or $99 if you have not paid us).
10. Indemnification
You agree to indemnify and hold harmless 209.works from any claims, damages, or expenses arising from your use of the platform, your violation of these terms, or your violation of any rights of another party.
11. Third-Party Services
We use third-party services including:
- Clerk: Authentication and user management
 - Stripe: Payment processing
 - Vercel: Hosting and file storage
 - Neon: Database services
 - OpenAI: AI-powered features (optional)
 
Your use of these services is subject to their respective terms and privacy policies.
12. Dispute Resolution
Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial or to participate in a class action lawsuit.
13. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notice. Continued use after changes constitutes acceptance of the modified Terms.
